By accessing or using Apex ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
Apex is a cloud platform-as-a-service (PaaS) that enables users to deploy, manage, and scale applications. The Service includes container orchestration, managed databases, and related infrastructure services.

We commit to 99.9% uptime for Pro and Enterprise plans. Scheduled maintenance windows are excluded.
Critical issues: 1 hour. High priority: 4 hours. Normal: 24 hours (business days).
You retain all rights to your content and applications. You grant us a limited license to host and serve your content as necessary to provide the Service. We retain all rights to the Apex platform, including software, APIs, and documentation.
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring your use of the Service complies with applicable data protection laws.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Apex from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
